Mango Markets Exploiter Avraham Eisenberg Sentenced to Over 4 Years for Child Pornography

The judge overseeing Eisenberg's case said he was considering allowing a retrial on fraud charges related to the Mango Markets theft.

NEW YORK, N.Y. — Mango Markets exploiter Abraham “Avi” Eisenberg, who stole $110 million from the now-defunct decentralized finance protocol in 2022, was sentenced Thursday to 52 months in prison — after pleading guilty to possessing child sexual exploitation material rather than on charges of cryptocurrency theft.

The sentencing comes a year after a New York jury found Eisenberg guilty of wire fraud, merchandise fraud and merchandise manipulation related to his Mango Markets stunt, and a year after he separately pleaded guilty to possessing child sexual abuse material (CSAM) that was found on his devices after his arrest.

Last year, defense attorneys moved for either a new trial or acquittal on the Mango Markets-related charges, arguing that the Justice Department tried the case in the wrong forum (the Southern District of New York), that the government failed to properly prove that MNGO Perpetual was an “exchange,” that Eisenberg intended to manipulate the price of MNGO Perpetual, and that his “alleged deceptions…were immaterial.”

At a hearing in Manhattan on Thursday, Judge Arun Subramanian said he would sentence Eisenberg to more than four years at FCI Otisville, a medium-security correctional facility about two hours outside Manhattan, but that there was a “non-zero probability that I would grant that motion” on the Mango Markets-related charges.

The judge also noted that the bulk of the sentence would relate to charges relating to violence against women.

“I think in this particular area general deterrence carries more weight… the only way to try to stop the spread of this material” is through jail, the judge said before reading evidence from three witnesses.

The judge added that he acknowledged Eisenberg's efforts to better understand the consequences of his crime, but that prison time was still necessary. Eisenberg was given a five-year suspended sentence with strict rules upon release from prison, the judge said, but he will have to install monitoring software on all of his electronic devices and complete an outpatient drug treatment program.
