Typical cryptocurrency theft schemes revealed in Russia

Supreme Court judge Yevgeny Rudakov spoke about typical cryptocurrency theft schemes, RBC Crypto reports. Speaking at the St. Petersburg International Legal Forum (SPILF), Rudakov said that most cryptocurrency crimes in Russia are committed through fraud.

Most often, cryptocurrency is stolen under the guise of exchange or investment services. There are also cases of violent seizure of assets, including the kidnapping of owners with subsequent coercion to hand over access to wallets.

Cases of encroachment on citizens' cryptocurrency, according to Rudakov, were considered in different regions. Such actions were qualified by the courts, as a rule, according to the norms of the Criminal Code, which provide for liability for crimes against property, the report says.

In recent years, courts have considered more than 20 criminal cases on crimes related to the encroachment on digital currency belonging to citizens. Over the past two years, Moscow courts have considered seven such cases, and in the Moscow region – four.

Cryptocurrency, the judge said, also often figures in drug trafficking cases, where digital assets are subject to seizure and subsequent confiscation.

Also at the forum, Deputy Minister of Justice Vadim Fedorov reported that the department has prepared a bill that directly classifies digital currency as property subject to seizure and confiscation. The investigator will be able to seize “material media with access codes” or request from the court a “ban on transactions” with cryptocurrency.

According to Fedorov, it is planned to involve specialists in such actions, who will help determine the necessary measures to preserve assets. The bill has already been submitted to the State Duma and is being prepared for the first reading.

The Chairman of the Investigative Committee, Alexander Bastrykin, reported in mid-March that the draft law had been prepared. The Investigative Committee has been seeking to introduce these regulations for many years, explaining that otherwise it would be difficult to effectively combat illegal transactions with digital assets.

The rise in physical attacks on cryptocurrency owners is also being recorded in other countries. More than 20 violent incidents have been reported since the beginning of this year.
